Terms and Conditions of the contract and Rules for com.au Allocation Trademark Issues
Please note that the onus is on the Applicant to ensure the registration and use of a domain name does not contravene any third party's rights (such as those pertaining to a registered Trade Mark). If your domain name infringes on another party's registered Trade Mark, you could be sued for infringement!
You can conduct a search of the Trade Marks data base by accessing IP Australia's ATMOSS, visiting your nearest IP Australia State Office or contacting a Trade Mark agent. Alternatively IP Australia's trained staff from the Trade Marks Office can search for registered and pending trade marks for you. IP Australia provides this service from their site at: http://www.ipaustralia.gov.au/trademarks/index.shtml
